地方政府债券 地方政府债券的定义 地方政府债券是指地方政府根据信用原则、以承担还本付息责任为前提而筹集资金的债务凭证，是指有财政收入的地方政府及地方公共机构发行的债券。地方政府债券一般用于交通、通讯、住宅、教育、医院和污水处理系统等地方性公共设施的建设。同中央政府发行的国债一样，地方政府债券一般也是以当地政府的税收能力作为还本付息的担保。正因为如此，国外没有将一般责任债券和收益债券构成的集合称为地方政府债券，而是市政债券。因此，如果将来地方政府可以获准发行财政债券，应该将其与中央政府债券一并纳入政府债券即公债的范围进行统一管理和规范，而不宜教条地与市政企业收益债券一起形成市政债券范畴。美国的市政债券是从偿还责任的角度来定义的概念，因此，市政债券并非完全的政府债券，也许正因为如此，没有称为地方政府债券。我国所谓地方债券，是相对国债而言，以地方政府为发债主体。不过我国债券业内也往往把地方企业发行的债券列为地方债券范畴。20世纪80年代末至90年代初， 许多地方政府为了筹集资金修路建桥，都曾经发行过地方债券。有的甚至是无息的，以支援国家建设的名义摊派给各单位，更有甚者就直接充当部分工资。但到了 1993年，这一行为被国务院制止了，原因乃是对地方政府承付的兑现能力有所怀疑。此后颁布的《中华人民共和国预算法》第28条，明确规定“除法律和国务院另有规定外，地方政府不得发行地方政府债券”。 地方政府债券的安全性较高，被认为是安全性仅次于“金边债券”的一种债券，而且，投资者购买地方政府债券所获得的利息收入一般都免交所得税，这对投资者有很强的吸引力。 目前我国地方政府尚不能发行债券。[编辑] 地方政府发债优点和缺点 地方政府发债优点允许地方政府发行债券，无疑解决了地方政府财政吃紧的问题。地方政府可以根据地方人大通过的发展规划，更加灵活地筹集资金，解决发展中存在的问题。更主要的是，由于地方政府拥有了自筹资金、自主发展的能力，中央政府与地方政府之间的关系将会更加成熟，地方人大在监督地方政府方面将会有更高的积极性，中国的 宪政体制将会得到进一步巩固。地方政府发债缺点 地方政府发行债券筹集资金面临着《预算法》的制约。我国《预算法》严禁地方政府举债，地方政府发行债券必须修改法律，而这样做就意味着，在短期内地方政府发行债券不会成为现实。 地方政府发行债券将会产生一系列的法律问题，如果没有严格的约束机制，一些地方政府过分举债之后，将会出现破产问题。而我国目前尚未对政府机关破产作出明确的规定，一旦地方政府破产，中央政府将承担怎样的责任，地方人大将作出怎样的安排，所有这一切都必须通盘考虑。
