国债的形式特征国债的形式特征【国债的形式特征]一国中央政府取得财政收人的渠道很多，如税收、规费、国有企业上缴利润、国债等。其中，国债在当今社会里，已成为一国政府财政收入的一个比较重要的来源。国债在能为国家筹集财政资金这一点上，与财政收人的其他形式在质上是没有差别的。但国债作为财政收人的特定形式与其他财政收人形式相比是有一定区别的。这主要在于国债有其固有的形式特征。这些形式特征是国债区别于其他财政收入形式的基本标志，可归结为以下三点:第一，自愿性。所谓自愿性，是指国债的发行或认购应建立在认购者自愿承购的基础上。认购者买与不买，或购买多少，完全由认购者视其个人或单位情况自主决定。这一形式特征使国债有别于其他财政收入形式。众所周知，税收的课征是以国家的政治权力为依托的。政府课税就要以国家法律、法令的形式加以规定，并依法强制课征。任何个人或单位都必须依法纳税，否则就要受到法律的制裁，因而税收的形式特征之一，就是它的强制性。在日常生活中，人们常说税收是“硬”的，不能随便不缴，就是指的这种强制性。国有企业部分利润的上缴是以国家的资产所有权为依托的，因为国家是生产资料的所有者，自然可以占有国有企业的利润。任何国有企业都有义务依照有关规定按时、足额地上缴部分利润，因而国有企业上缴利润的形式，也可以说具有“半强制性”的特征。国家规定的各种规费，如工商执照费等，也是强制征收的。国债的发行则是以政府的信用为依托，所以中央政府发行公债就应以借贷双方的自愿互利为基础，按一定条件与国债认购者结成债权债务关系。在这一关系中，国家处于债务人的地位，无权要求其他经济实体无条件接受所发国债。任何个人或单位由于具有各自独立的经济利益，政府不可能也不应该强制他们认购国债，而只能由其自主决定买与不买或购买多少。这里要说明的是，在so年代初，由于我国中央政府所发国债(即国库券)不能流通，居民和单位均不愿购买，当时政府实行的是以派购国债的办法来筹集财政资金。但那只是解决财政困难的一种权宜之计，长期如此下去是难以为继的。而且进一步地讲，具有派购性质的国债也不是完全意义上的国债，人们对派购性质的国债往往将其与征税同样看待。第二，国债的有偿性。所谓有偿性，是指通过发行国债筹集的财政资金，政府必须把它当成一种负债而按期偿还。除此之外，还要按事先规定的认购条件向债权人支付一定数额的暂时让渡资金使用权的报酬，即利息，这也是国债区别于其他财政收人形式的重要特征。
