社会工作立法国家关于解决和预防社会问题、改善和管理社会生活、开展社会福利等方面工作的法律规范。又称社会立法。它是国家法律的一个组成部分。不同性质的国家，有不同的社会工作立法。西方最早实行社会立法的是英国。1531年，英国巴力门通过了一项法律，规定征收救济品并由地方当局分发给贫民，这是历史上第一个济贫法规；1597年，又通过一个法律，规定征税以救济贫民。1601年，英国伊丽莎白女王颁布济贫法，即《伊丽莎白第43号法》，它是前几个世纪贫民救济立法的集成，现代公共救济立法大都以此为依据。1883年德国政府颁布的社会保险法，一般认为是现代国家社会立法的标志。随后，各国相继制订并颁布了一系列社会工作法规。截至1979年，世界上已有 134个国家和地区实行社会立法制度，涉及的内容主要包括失业救济、贫困救助、老年保险、残疾人救济、儿童救济与儿童福利、公共卫生等。如1935年美国制订的《社会安全法案》主要内容有：①社会保险法案，包括老年保险制度、失业补偿制度；②公共分类救助方案，包括对老年人、贫苦盲人及无依靠的儿童的救助，1950年又增加了对永久或完全残废者救助的条款；③卫生与福利服务方案，包括妇幼卫生服务、残废儿童服务、儿童福利服务，以及公共卫生服务等条款。中国的社会工作立法的基本内容，在《中华人民共和国宪法》中有根本性的规定。国家从1951年起，就先后进行了一系列专门性的社会工作立法，涉及劳动保险、公费医疗、伤亡褒恤、干部老弱病残安置、离休退休退职、烈士褒扬、军人抚恤优待、复员和退伍义务兵安置、救济救灾、游民收容遣送、婚姻、殡葬、城市社会福利管理、社会基层管理、社团登记与管理等方面的内容。中华人民共和国建立40年，政府管理社会行政事务的民政部门所依据的社会工作法律有34件,行政法规有231件，条例规章等2000余件。社会工作法制日趋完善。
