法律责任形式法律责任形式【法律资任形式l第一，宣布为市场禁人者。该处罚是期货市场惩治违法行为的特有的处罚措施，它和市场禁止进人制度相联系。所谓市场禁止进人制度是指各期货交易所、期货经纪公司对被宣布为市场禁人者的机构和个人，3年内不得接受其从事期货交易的制度。根据中国证监会《关于各期货交易所建立“市场禁止进人制度”的通知》的规定，各交易所要结合各自的具体情况建立市场禁止进入制度，报中国证监会备案。经查实有下列行为之一的，交易所要宣布为市场禁人者:①被交易所认定有操纵市场行为或者其他涉及欺诈行为的机构和个人;②严重违反国家有关金融证券期货等法律、法规，蓄意违反交易所的有关规章制度，造成严重后果的机构和个人;③采取造谣、诬告等手段散布虚假信息、扰乱市场秩序，造成严重后果的机构和个人。各交易所要将认定的“市场禁人者”及时通报中国证监会，由中国证监会通报其他各交易所。被通报的“市场禁人者”，各交易所、经纪机构3年内均不得为其办理期货交易开户手续，对已开户的，除清理原有持仓的交易指令外，要立即停止接受其新的交易指令。被认定为市场禁人者的机构的主要负责人和直接责任人员，各交易所、经纪机构均不得接受其从事期货业务。违反规定接受“市场禁人者”的期货交易所和经纪机构，中国证监会依情况给予处罚，蓄意违规构成犯罪的由司法部门追究刑事责任。对市场禁止进人制度我们的理解是:该制度既是期货交易所的自律措施，也是一种行政处罚形式。哪些违规行为人应宣布为市场禁人者，由各交易所决定，但属证监会明令列举的行为各交易所必须执行，这属强制性规定。各交易所宣布的“市场禁人者”只有被证监会通报后，才对其他交易所产生相应的法律后果。该处罚的对象是交易所的会员和在经纪机构开户的投资客户，此外还涉及市场禁入者机构内的主要负责人和直接负责人员。第二，暂停、中止、取消交易所试点资格。我国交易所建设是从批发市场逐渐过渡发展起来的，走一条由试点到逐步规范的道路。19男)年开始试点建设，1993年掀起市场建设的高潮，1994年国家对期市进行了整顿，199落年底13家交易所挂牌试点，另2家完成整顿后才挂牌。何时结束试点阶段尚不可知。因此，在目前阶段，各交易所的资格没有完全确立，交易所如果有违法行为时就可能面临被暂停、中止或者取消试点资格。在一段时间内不得从事期货交易、或者丧失从事期货交易的资格。第三，取消期货经纪业务的资格。
